The recently-published Chambers Litigation Global Practice Guide includes an article contributed by four VHH attorneys that examines the Texas Business Court system. Firm partners Alix Allison, Richard Guiltinan, Daniella Main, and associate Catherine Pritchard outline the structure of the year-old institution, created by the Texas Legislature to modernize the state’s corporate law provisions and position Texas as a leading venue to resolve business litigation. While this system is still in its infancy, the initial procedural rulings provide guidance on questions of jurisdiction, pleading and drafting strategy. The article notes the early impact of those rulings for specific industries, particularly oil & gas and healthcare-related litigation, and reviews some of those decisions in more detail.
